These Terms and Conditions govern the purchase of your Membership ("Membership") to Major Savings and your access and use of our online tools and platform and any other content therein, ("Our Platform").
Legally Binding
These Terms and Conditions are a legally binding contract between you and us. By becoming a member of Major Savings ("Member") or accessing Our Platform and Services ("Services") through this website, mobile or tablet application, any of our websites or other platforms of our affiliates, providers, business partners, you agree to be bound by these Terms and Conditions, our Acceptable Use Policy and our Privacy Policy, and any applicable terms from third party benefit providers with whom you elect to transact through. It is your responsibility to periodically check these Terms and Conditions for any amendments to the Terms and Conditions.If you access or use Our Platform, or continue accessing or using Our Platform, you confirm that you have read, understand and agree to be bound by these Terms and Conditions and the Acceptable Use Policy. If you do not accept all of these Terms and Conditions, then you may not use Our Platform. In these Terms and Conditions, "we", "us", "our" or "Major Savings" refers to Radius Holdings, LLC, dba Major Savings, and "you" or "your" refers to you as a purchaser Major Savings and any customer visiting or using Our Platform and/or booking a reservation through us on Our Platform, or through our customer service agents. THESE TERMS AND CONDITIONS INCLUDE AN ARBITRATION CLAUSE AND A WAIVER OF YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE LAWSUIT defined below under DISPUTE RESOLUTION. We reserve the right to modify or replace these Terms and Conditions or Acceptable Use Policy at any time and in our sole discretion. When we do, we will update the last revised date at the top of this Agreement. Any changes will be effective immediately upon posting the revised version (or such later effective date as may be indicated at the top of the revised Terms and Conditions). It is your responsibility to regularly check Our Platform to determine if there have been changes. Your continued use of Our Platform following the posting of any changes to the Terms and Conditions will constitute your acceptance of any such changes and your agreement to be bound by these Terms and Conditions and Acceptable Use Policy. If you object to any provision of these Terms and Conditions or any subsequent modifications to these Terms and Conditions or become dissatisfied with Our Platform in any way, your only recourse is to immediately terminate use of Our Platform.

Authorized User
You are an Authorized User on Our Platform and your account can only be activated/accessed through this website, mobile or tablet application. You have unlimited access to the Major Savings 24 hours a day, 7 days a week, 365 days a year (with exception for limited occasions of reasonable maintenance, service disruptions, etc.)
Authorized User Compliance
To the extent prohibited by applicable law, Our Platform is not intended for and should not be used by anyone not of sufficient legal age. You represent that you are over the legal age and are the intended user of Our Platform. You may not access or use Our Platform for any purpose if either of the representations in the preceding sentence is not true. Without limiting the foregoing, you must be of legal working age. To help ensure a safe and productive work environment, all Authorized Users must comply with our Terms and Conditions and Acceptable Use Policy and any applicable policies established by our third party benefit providers we transact through. These Terms and Conditions remain effective until your Membership is cancelled by you, or your access to Our Platform has been terminated by us for whatever reason. Please contact Major Savings if you at any time or for any reason wish to terminate your account, including due to a disagreement with any updates to these Terms and Conditions or the Acceptable Use Policy.
Use of Our Platform
For Authorized Users using Our Platform to book travel for themselves, their families, their coworkers, or their friends, Major Savings grants you a limited and revocable right to use Our Platform for those purposes. You represent that all information you supply to Major Savings or in the course of using Our Platform is true, accurate, current and complete. If you book travel found on Our Platform on another person's behalf, you represent that you are authorized to make that booking, and you agree to inform that person about all terms, conditions, rules, and restrictions applicable to that booking. Without separate, written permission from Major Savings in advance, you may not: (i) reuse or "scrape" Major Savings' data for use in another service or website, (ii) attempt to circumvent any controls or limitations Major Savings places on your ability to access Our Platform, including by means of robot exclusion headers, (iii) use any bots, scrapers, brute-force tools, or other automated methods for accessing, slowing down, or disabling Our Platform or otherwise interfering with the proper function of Our Platform, (iv) "frame," "mirror," or otherwise incorporate any part of Our Platform into any other website or service, or (v) take any action that imposes, or may impose (as determined at our discretion), an unreasonable or disproportionately large load on Our Platform.
If you become an Authorized User or make a booking resulting in the creation of an account, you are responsible for maintaining the secrecy of your passwords, login and account information. You will be responsible for all use of Our Platform by you, anyone using your password and login information (with or without your permission) and anyone whom you allow to access your travel itineraries. Note that some email communications from us may automatically log a user into their account. If you forward an email communication to another individual, you acknowledge that the user may gain entry into your account to view your travel information. All information that you provide to us must be accurate and up to date. If any of your information changes, you must immediately update it. If you have reason to believe that your account is no longer secure (e.g., loss, theft or unauthorized disclosure or use of your information or computer or mobile device used to access Our Platform), you must promptly change your personal information that is affected. You warrant that you have given express consent to (a) the processing of your personal information by hotels, service providers and any other third parties engaged by Major Savings for the purpose of dealing with bookings; and (b) the export of your Personal information to any country in the world.
You may only use Our Platform to search for legitimate travel deals and you may not use Our Platform to make any false, fraudulent or any reservation in anticipation of spikes in demand. By using Our Platform, you agree to comply with laws that apply to the United States and your own country, including laws that apply to exporting technical data.
Membership, Subscriptions; Charges on Your Account
Major Savings charges you for your access to the Service using the billing information you provide (your "Account") at the time of enrollment. By enrolling in Major Savings, You authorize Major Savings to charge your Account the fees then in effect for the Service. Major Savings reserves the right to correct any errors or mistakes that it makes, even if it has already requested or received payment, and to update your information from available third-party sources. All membership fees are in US Dollars.
Recurring Subscription
Access to the Major Savings requires a recurring subscription (“Recurring Subscriptions”)and may consist of an initial period, where you can try the Services for free or for an introductory trial, followed by recurring period charges authorized and agreed to by you at the time of your subscription. If your membership subscription has an initial and recurring payment feature, you accept responsibility for all recurring charges prior to cancellation. To change or cancel your membership at any time, go to your Account page, or send your request to us using the "Contact Us" link on any page of the Site. Members paying on the monthly payment plan will not be eligible for a refund for a partial month or partial quarter upon termination/cancellation. Your non-termination or continued use of the Service reaffirms that Major Savings is authorized to charge your Payment Method on the recurring basis you agreed to upon enrollment. Major Savings may submit those charges for payment, and you will be responsible for such charges. MAJOR SAVINGS MAY SUBMIT PERIODIC CHARGES WITHOUT FURTHER AUTHORIZATION FROM YOU, UNTIL YOU AFFIRMATIVELY CANCEL YOUR MEMBERSHIP OR NOTIFY US THAT YOU WISH TO CHANGE YOUR PAYMENT METHOD. SUCH NOTICE WILL NOT AFFECT CHARGES SUBMITTED BEFORE MAJOR SAVINGS REASONABLY COULD ACT. TO CHANGE YOUR PAYMENT METHOD, GO TO THE "HELP" SECTION OF THE WEBSITE.
Cancellation
You must cancel your Recurring Subscription at least 24 hours before the end of your current subscription period to avoid being charged for the next subscription period. You can cancel at www.majorsavings.com by logging into your account and clicking on the 'Cancel Membership' tab. Click on the 'Get Help' link in the footer if you need assistance with canceling a Recurring Subscription. If you cancel, you are not entitled to a refund for the fees you already paid, but, subject to these Terms and Conditions, you will continue to receive access to Major Savings until the end of your current subscription period.
Payment Method
The terms of your payment will be based on your Payment Method and may be determined by agreements between you and the financial institution, credit card issuer, or other provider of your chosen Payment Method (the "Payment Method Provider"). If Major Savings does not receive payment from your Payment Method Provider, you agree to pay all amounts due on your Billing Account upon demand.
Action is Required to Claim Your Benefits
Action on your part is required to activate and claim your Major Savings benefits. Benefits associated with Major Savings may accrue/rollover from month to month.
Discounts
Discounts (if applicable) are valid at participating locations. Certain restrictions may apply. Participating locations and savings vouchers may be added or deleted and the level of discounts are subject to change at any time without notice.
Major Savings may make Promotional Offers available to be redeemed to access the Major Saving’s service (each a “Promotional Offer”). Each Promotional Offer is made available by Major Savings in connection with a paid Major Savings subscription or Major Savings free trial (the “Participant/s”) and is subject to Major Saving’s Terms and Conditions and Privacy Policy.
Promotional Offers
A Promotional Offer must be accepted before the applicable expiration date advertised, if any. Except where prohibited by law, Major Savings reserves the right to modify, suspend, or terminate a Promotional Offer at any time and for any reason, in which case Major Savings may not honor subsequent Promotional Offer enrollments.
If required to submit your payment details to redeem a Promotional Offer, you (i) confirm your acceptance of the Promotional Offer as advertised; (ii) accept and agree to these Promotional Offer Terms, including the relevant terms and conditions corresponding to Major Savings Services as set forth above; and (iii) acknowledge and agree to the Major Savings Terms of Service.
Eligibility
In order to be eligible for a Promotional Offer, users must satisfy all of the following conditions (each an "Eligible User"):
A. You submitted a Promotional Offer code or fulfilled the requisite redemption criteria as advertised (the "Promotional Period”).
B. Unless you are subscribing to a Promotional Offer that is advertised as available to past subscribers to the Service, you must be a new subscriber to any and all forms of the Service (as defined in Major Savings Terms of Service) and not have subscribed to, or accepted a trial of, the Service at any time in the past.
C. If you are accepting a Promotional Offer that is advertised as available only to past subscribers to a Service, you must have been a subscriber to the relevant Service (as advertised) whose subscription expired before the date advertised.
D. Unless otherwise advertised, provide Major Savings with a valid and current payment method that is approved by Major Savings (prepaid cards and gift cards are not valid forms of payment).
E. Unless otherwise advertised, provide the payment method above directly to Major Savings and not through a third party.
F. Additional eligibility requirements (if any) as advertised from time-to-time in connection with a Promotional Offer.
G. Eligible Users may accept a Promotional Offer once - previous users may not redeem the offer again.
A Promotional Offer must be accepted before the applicable expiration date advertised, if any. Except where prohibited by law, Major Savings reserves the right to modify, suspend, or terminate a Promotional Offer at any time and for any reason, in which case Major Savings may not honor subsequent Promotional Offer enrollments. Major Savings reserves the right, in its discretion, to determine your Promotional Offer eligibility, and to modify or cancel a Promotional Offer at any time. Promotional Offers may only be claimed through www.majorsavings.com by any advertised expiration date.
Free Trial or Discounted Subscription Rules
A Promotional Offer may provide access to a Free Trial or Discounted Subscription of Major Savings:Promotional Offers Converting to Recurring Subscriptions.
You may be offered a Promotional Offer in connection with a Recurring Subscription, such as a trial period or initial discount. Additional terms specific to each Promotional Offer we offer will be as described in the particular offer (“Offer Terms”). You must meet all eligibility requirements stated in these Terms and the Offer Terms to enroll in a Promotional Offer. Unless stated otherwise in the Offer Terms, Promotional Offers are only for new customers who have not previously subscribed to Major Savings or enrolled in a Promotional Offer. If the Offer Terms state that an offer is available only to past subscribers, you must have been a subscriber to Major Savings and allowed your subscription to expire during the Promotional Period in the Promotional Offer description. Major Savings reserves the right, in its discretion, to determine your Promotional Offer eligibility, and to modify or cancel a Promotional Offer at any time. Promotional Offers may only be claimed through www.majorsavings.com by any advertised expiration date.
Bonus Offer Rules
Promotional Offer may also provide access to a bonus offer ("Bonus Offer") that can be redeemed with a paid Major Savings subscription or Major Savings free trial.
Major Savings reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend Promotional Offer should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its reasonable control corrupt or affect the administration, security, fairness or proper conduct of the Free Gift promotion. Major Savings may prohibit a Participant from participating in the Promotion or receiving the Bonus Offer if, in its sole discretion, it determines that said Participant is attempting to undermine the legitimate operation of the Promotional Offer by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other Participants or Major Savings representatives.
In order to receive the Bonus Offer, eligible Participants must log in to their Major Savings account, click on the Forms link and follow the redemption instructions for the Bonus Offer they are eligible to receive.
The Bonus Offer amounts quoted are subject to availability and, in the event of unforeseen circumstances, or circumstances outside of the Major Saving’s reasonable control, Major Savings reserves the right to amend, withdraw or substitute any part of this Promotion and/or Free Gift for an alternative arrangement of equal or greater value.
Duration; cancellation
The Promotional Period for a corresponding Promotional Offer shall continue for the period as advertised, subject to Eligibility section above. If the Promotional Offer as advertised required your membership to or purchase of a third-party product or service, failure to maintain such membership or purchase will result in cancellation of your access to the Service. Unless you cancel a Promotional Offer before the end of the Promotional Period, you will automatically become a recurring subscriber to the Service type that you redeemed as part of the Promotional Offer and the payment method you provided will automatically be charged the then-current annual price (unless otherwise advertised). If you cancel a Promotional Offer during the Promotional Period, you will lose access to the Service and, if granted access to the Major Savings Service through your Promotional Offer, your Major Savings account will switch to a Major Savings account at the end of the Promotional Period. To cancel, you must log into your Major Savings Account and follow the instructions.
Save where the Major Saving has been negligent or in relation to the Major Saving's fraud and to the extent permitted by law, the Promotion Company shall in no way be liable for any injuries, losses, damages or expenses suffered or incurred by any recipient of a Bonus Offer, as a direct or indirect result of participating in this Promotion and/or accepting the Bonus Offer.
Acceptance of these Rules is a condition of receiving your Free Gift and redeeming your Bonus Offer indicates full acceptance of these Rules.
Products and Services
We partner with third-party service providers ("Service Providers") who offer products and services to you. In most cases, we act as an intermediary between you and the Service Providers. Products or services that you purchase using your Membership are provided directly by the Service Provider. We are not responsible for the actions or inactions of the Service Providers, their breach of contract, their failure to comply with any laws, or any intentional or negligent actions or omissions on the part of such Service Provider or Service Provider's subcontractors, which may result in any loss, damage, delay, inconvenience or injury to you. In no event will we be liable for any damages in connection with a product or service obtained by you from a Service Provider.
Booking Travel Through Our Travel Partners
Our Platform offers you the ability to book travel with third-party travel partners through the Major Savings travel service. Major Savings does not own or control any of the travel services and products that you can access through Our Platform, such as flights, accommodations, rental cars, packages, or travel insurance (the "Travel Products"). The Travel Products are owned, controlled, or made available by third parties (the "Travel Providers") either directly (e.g., airline) or as an agent (e.g., online travel agency). The Travel Providers and end travel suppliers are responsible for the Travel Products and the eventual fulfillment thereof. The Travel Provider's terms and privacy policies apply to your booking so you must agree to and understand those terms. Further, the terms of the actual travel provider (airline, hotel, rental cars, tour operator, etc.) apply to your travel, and may be incremental and separate from those presented through the Major Savings platform, which they may require of you during their check-in process. Your interaction with any Travel Provider accessed through Our Platform is at your own risk and Major Savings does not have any responsibility should an issue arise with your booking or any issues during your travel and is ultimately between you and the supplier of the end travel product (airline, hotel, rental car, tour operator, etc.). Our Platform hosts content, including prices and savings claims, made available by or obtained from Travel Providers. Major Savings is in no way responsible for the accuracy, timeliness, or completeness of such content. Since Major Savings has no control over the Travel Products and does not verify the content provided by the Travel Providers, it is not possible for us to guarantee the prices displayed on Our Platform. You authorize us to book reservations on your behalf with Travel Providers. You agree that your credit card will be charged for the total reservation price plus any applicable taxes. Additional charges (e.g., payment fees, services charges, resort fees, checked-in luggage fees, deposits, or local taxes and fees) that are not part of the original reservation price may also be charged directly by the hotel property, car rental company or other merchant.
Travel Cancellations
Cancellations to a hotel or car rental reservation must be made through us by contacting our member service team by calling the phone number listed on the website, via chat or the email address provided in the reservation confirmation email which is sent to the email address you have on file with us. You agree to abide by the cancellation policy that was provided to you on our website during the booking process and provided to you in the reservation confirmation email.
Currency Conversion
The currency rates that may be provided when booking services are based on publicly available sources. Actual rates may vary. We do not guarantee the accuracy of the currency information we supply on the website. When using this information, we advise you to independently verify the accuracy of the currency rates. The currency rates provided are for your personal use and you are not permitted to resell, redistribute, or use this information for commercial purposes.
Mobile Application
The Terms and Conditions outlined in this document also apply to using our services via our Mobile Application. We grant to you a non-exclusive, non-transferable license to download, install and use the Mobile Application. You will be bound by the same Terms and Conditions as on Our Platform for use of the Mobile Application. All references to "Our Platform" in this document shall also apply to your use of the Mobile Application. The Mobile Application automatically collects information related to any technical errors you may encounter as well as how you are using the Mobile Application including the content you are accessing. By using the Mobile Application, you agree and consent to the collection of this information.
Travel Programs - Cash back or Rewards
Some users may be offered the ability to earn cash back ("Cash Back" or "Rewards") on their purchases completed through Our Platform. This Cash Back may be rewarded in dollars, points, miles, cryptocurrency, or other currency as defined by the program. Cash Back or Rewards are earned based on the net purchase amount which excludes taxes, fees, discount, credits, or cancellations. We are not responsible for the distribution of the Cash Back or Rewards from third-party programs. Any distribution errors or questions should be directed to the third-party program in which you are registered to earn Cash Back or Rewards.
Hotel Reviews
The reviews and ratings showcased on our platform are sourced from Expedia, Inc. (“Expedia”). The ownership and intellectual property rights of these reviews belong to Expedia or the respective reviewers. While we make every effort to offer accurate and dependable reviews, we cannot guarantee the authenticity, accuracy, or completeness of the reviews. Any inaccuracies or misinformation in the reviews and ratings are not our responsibility. We do not possess the capability to edit or remove specific reviews or ratings displayed on our platform since they are directly retrieved from Expedia's API. We are not responsible for any concerns or disputes regarding particular reviews. The content and opinions expressed in the reviews solely represent those of the original reviewers. We are not liable for their statements or any consequences that may arise from them. Users should exercise their own judgment when relying on the reviews and ratings. We hold no liability for any damages, losses, or harm resulting from the utilization of the reviews and ratings provided through Expedia. International Travel
You are responsible for ensuring that you meet foreign entry requirements and that your travel documents, such as passports and visas (transit, business, tourist, and otherwise), are in order and any other foreign entry requirements are met. Our Platform has no special knowledge regarding foreign entry requirements or travel documents. We urge customers to review travel prohibitions, warnings, announcements, and advisories issued by the relevant governments prior to booking travel to international destinations.
BY OFFERING RESERVATIONS FOR TRAVEL PRODUCTS, IN PARTICULAR INTERNATIONAL DESTINATIONS, WE AND OUR BUSINESS PARTNERS AND CLIENTS DO NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH AREAS IS ADVISABLE OR WITHOUT RISK AND WE AND OUR BUSINESS PARTNERS AND CLIENTS ARE NOT LIABLE FOR DAMAGES OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS.

Major Savings and its respective suppliers, business partners and clients disclaim all warranties and conditions that Our Platform, its servers or any email sent from Major Savings and/or its respective suppliers, business partners and/or clients are free of viruses or other harmful components. Major Savings and its respective suppliers, business partners and clients hereby disclaim all warranties and conditions with regard to this information, software, products and services, including all implied warranties and conditions of merchantability, fitness for a particular response, title and non-infringement.
IN NO EVENT WILL YOU OR WE HAVE ANY LIABILITY TO THE OTHER FOR ANY LOST PROFITS OR REVENUES OR FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, COVER OR PUNITIVE DAMAGES HOWEVER CAUSED, WHETHER IN CONTRACT, TORT OR UNDER ANY OTHER THEORY OF LIABILITY, AND WHETHER OR NOT THE PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU WILL HAVE NO FINANCIAL LIABILITY TO US FOR A BREACH OF THESE USER TERMS. OUR MAXIMUM AGGREGATE LIABILITY TO YOU FOR ANY BREACH OF THE USER TERMS IS ONE HUNDRED DOLLARS ($100) IN THE AGGREGATE. THE FOREGOING DISCLAIMERS WILL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW AND DO NOT LIMIT EITHER PARTY'S RIGHT TO SEEK AND OBTAIN EQUITABLE RELIEF.
In no event shall Major Savings and/or its respective suppliers, business partners and/or other third parties we may transact through be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or in any way connected with, your Major Savings to, display of or use of Our Platform or with the delay or inability to Major Savings, display or use Our Platform (including, but not limited to, your reliance upon opinions appearing on this Platform; any computer viruses, information, software, linked sites, products and services obtaining through this Platform; or otherwise arising out of the access to, display of or use of this Platform) whether based on a theory of negligence, contract, tort, strict liability, consumer protection statutes, or otherwise, and even if Major Savings and/or its respective suppliers, business partners and/or third parties we may transact through have been advised of the possibility of such damages.
The limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these Terms and Conditions is found to have failed of its essential purpose. The limitations of liability provided in these Terms and Conditions inure to the benefit of Major Savings and/or the respective suppliers, business partners and clients.
Survival
The sections titled "Authorized User", "Authorized User Compliance", "Use of the Platform", "Limitation of Liability," and "Survival," and all of the provisions under the general heading "General Provisions" will survive any termination or expiration of the Terms and Conditions.
Dispute Resollution
You agree that by accepting these Terms and Conditions, you and Major Savings are each waiving the right to trial by jury and the ability to participate in any class action suit and that any and all Claims will be resolved by binding arbitration, rather than in court, except you may assert Claims on an individual basis in small claims court if they qualify.
You agree that any and all disputes, claims or controversies Major Savings or you have relating in any way to the services or your relationship with Major Savings including without limitation with respect to data, your interaction with Major Savings, Major Savings' advertisements and disclosures, email and mobile messages Major Savings may send to you, the use or disclosure of any information about you, any dealings with our customer service agents, these Terms and Conditions, and Privacy Policy (collectively, "Claims") will be submitted to arbitration in Salt Lake City, Utah. This also includes any Claims that arose before you accepted these Terms and Conditions, regardless of whether prior versions of the Terms and Conditions required arbitration. This includes any Claims you assert against us, our travel suppliers, business partners or any companies offering products or services through Major Savings. Claims include claims based on contract, tort (including intentional tort), fraud, agency, your or Major Savings' negligence, statutory or regulatory provisions, or any other source of law.
In arbitration, a dispute is resolved by an arbitrator instead of a judge or jury. The arbitrator's decision will generally be final and binding, with no right of appeal. Arbitration procedures are simpler and more limited than court procedures.
Arbitrations will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA Consumer Rules. Payment of all filing, administration and arbitrator fees will be governed by the AAA's rules, except as provided in this section. If your total Claims seeks less than $10,000, we may reimburse you for filing fees you pay to the AAA and arbitrator's fees. You may choose to have an arbitration conducted by telephone, based on written submissions, or in person in the state where you live or at another mutually agreed location.
If you elect to seek arbitration, you must first send to Major Savings, by certified mail, a written Notice of Dispute ("Notice"). The Notice to Major Savings should be addressed to: Major Savings Rewards Service Center P.O. Box 8788, Virginia Beach, VA 23450-8788, Attn: Major Savings Legal.. If we request arbitration against you, we will give you notice at the email address or street address you have provided. The AAA's rules and filing instructions are available at http://www.adr.org or by calling 1-800-778-7879.
Any and all proceedings to resolve Claims will be conducted only on an individual basis and not in a class, consolidated or representative action. The Federal Arbitration Act and federal arbitration law apply to this agreement. An arbitration decision may be confirmed by any court with competent jurisdiction. The arbitrator will have authority to decide issues as to the scope of this arbitration agreement and the arbitrability of Claims. If for any reason a Claim proceeds in court rather than in arbitration, both Major Savings and you waive any right to a jury trial.
General Provisions

Please review our Privacy Policy for more information on how we collect and use data relating to the use and performance of Our Platform. By using Our Platform, you agree to be bound by our Privacy Policy. Please be advised Our Platform is hosted in the United States. If you access Our Platform from any other region of the world with laws or other requirements governing personal data collection, use, or disclosure that differ from applicable laws in the United States, then through your continued use of the Services, you are transferring your data to the United States, and you expressly consent to have your data transferred to and processed in the United States.
Waiver
No failure or delay by either party in exercising any right under the Terms and Conditions, including the Acceptable Use Policy, will constitute a waiver of that right. No waiver under the Terms and Conditions will be effective unless made in writing and signed by an authorized representative of the party being deemed to have granted the waiver.
Severability
The User Terms, including the Acceptable Use Policy, will be enforced to the fullest extent permitted under applicable law. If any provision of the User Terms is held by a court of competent jurisdiction to be contrary to law, the provision will be modified by the court and interpreted so as best to accomplish the objectives of the original provision to the fullest extent permitted by law, and the remaining provisions of the User Terms will remain in effect.
Assignment
You may not assign any of your rights or delegate your obligations under these User Terms, including the Acceptable Use Policy, whether by operation of law or otherwise, without the prior written consent of us (not to be unreasonably withheld). We may assign these User Terms in their entirety (including all terms and conditions incorporated herein by reference), without your consent, to a corporate affiliate or in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets.
Disclosure
We may receive compensation for recommendations made in reference to the products or services on this website. This compensation may be in the form of money, services or complimentary products and could exist without any action from a website visitor. Should you purchase a product or service that was recommended by this website, it is understood that some form of compensation might be made to the website owner.
Entire Agreement
The Terms and Conditions, including any terms incorporated by reference into the Terms and Conditions, constitute the entire agreement between you and us and supersede all prior and contemporaneous agreements, proposals or representations, written or oral, concerning its subject matter. To the extent of any conflict or inconsistency between the provisions in these Terms and Conditions and any pages referenced in these Terms and Conditions, the terms of these Terms and Conditions will first prevail; provided, however, that if there is a conflict or inconsistency between the Contract and the Terms and Conditions, the terms of the Contract will first prevail, followed by the provisions in these Terms and Conditions, and then followed by the pages referenced in these Terms and Conditions (e.g., the Privacy Policy). Major Savings will be responsible for notifying Authorized Users of those conflicts or inconsistencies and until such time the terms set forth herein will be binding.

The headings, captions, headers, footers and version numbers contained in this Agreement are intended for convenience or reference and shall not affect the meaning or interpretation of this Agreement.
Acceptable Use Policy
This Acceptable Use Policy sets out a list of acceptable and unacceptable conduct for Our Platform. If we believe a violation of the policy is deliberate, repeated or presents a credible risk of harm to other users, our customers, Our Platform or any third parties, we may suspend or terminate your access. This policy may change as Our Platform grows and evolves, so please check back regularly for updates and changes. Capitalized terms used below but not defined in this policy have the meaning set forth in the Terms and Conditions.
